Legal Consultation
At Memorial Employee Assistance Services, our professional legal service is designed to help answer a variety of common legal questions. Legal consultations are primarily conducted over the phone, but upon request, arrangements will be made to schedule an in-person appointment with a local network attorney. An initial 30-minute consultation is provided at no cost to you. A 25% discount is available for any service beyond the initial consultation. Consultation services related to employment disputes or document review are not covered under the EAP legal consultation.
MEAS contracted attorneys provide assistance in a variety of specialty areas including:
- Adoption
- Child Custody – New and revisiting existing agreements
- Child Support – New and revisiting existing agreements
- Credit or Debit Issues – Cease and desist letters (after financial education/payment plan is started)
- Criminal - Information about the next steps, process or advice about whether to retain an attorney can be provided by the telephone attorney network. Juvenile and adult misdemeanors and felonies (most are assault, driving under the influence and sexual charges) are covered.
- Divorce – Initial consultation with a lawyer for simple or contested divorce;
- DUI/DWI
- Elder Law – Powers of Attorney, Medicare/Medicaid planning. Due to the specialization around Medicare/Medicaid, it may take longer to locate an available attorney as most are booked with current cases.
- Estate Planning – Includes planning for people with special needs and general estate planning.
- Grandparents' Rights
- Guardianship or Conservatorship - Both minors and mentally incompetent adults
- Immigration – Deportation, green card and visa issues
- Landlord/Tenant - Tenant representation for eviction proceedings
- Medical Malpractice - All types including dental, surgical and general practice
- Medicare - Issues with Medicare reimbursement/hearings on denials of payments
- Name Change - Both for adults and minors with adoption proceedings
- Nursing Home - Ombudsman issues with care issues and payment issues including spend-down for Medicaid (MediCal)
- Power of Attorney (POA) - Includes durable healthcare power of attorney, durable POA for finance
- Probate - Filing of estates, contesting wills
- Real Estate - Both buying and selling as well as general property issues
- School Issues - Advocating for independent education programs (IEPs) and discrimination issues
- Social Security/Disability - Assisting with application and hearing process for denials. This is a highly specialized area of law and may require longer to confirm an attorney.
- Taxes - Audit representation or legal proceedings of taxes (submitted or not)
- Traffic Tickets – Advice (telephone attorney can only give advice) and/or representation in court if permitted in the particular jurisdiction
- Trusts - Setting up probate trusts as well as trusts for incapacitated adults
- Wills - Simple will and living wills.
